California tribes back non-Native tenants’ bid to scrap property taxes

By Caleb Symons (April 22, 2022, 8:41 p.m. EDT) — A group of California tribes urged the U.S. Supreme Court on Thursday to bar states and municipalities from imposing property taxes on non-Native tenants of Native American land, saying that these violate their sovereignty and undermine their prospects for economic growth.

In an amicus brief, the four tribes and a tribal trade consortium said a certiorari application last month from non-Native tenants “presents an ideal opportunity” to clarify whether federal rules prevent state and local taxes on these properties and whether this prohibition extends to tribes. unacquired trust lands under the Indian Reorganization Act of 1934.
